Terms of Use
1. Registration on the Site
Simple browsing of the Site is free and does not require registration. To make a purchase and use the Services, the Member must register on the Site by completing the form provided for this purpose [citation:4].
The Member must provide proof of identity and provide all information and documents marked as mandatory in the registration form. Any incomplete registration will not be validated [citation:4][citation:7].
Registration automatically results in the opening of an account in the Member's name, giving them access to a personal space to manage their use of the Services [citation:4][citation:7].
The Member guarantees that all information provided is accurate, up-to-date, and truthful. They undertake to update this information in the event of changes [citation:4][citation:7].
2. Account Security
The Member may access their Personal Space at any time after identifying themselves using their public pseudonym, login ID, and four-digit secret key [citation:2][citation:4][citation:7].
The Member undertakes to use the Services personally and not to allow any third party to use them on their behalf, except at their own full responsibility. They are responsible for maintaining the confidentiality of their identifier and secret key [citation:2][citation:4][citation:7].
The Member must immediately contact the Company if they notice that their Account has been used without their knowledge. Any transaction carried out from the Personal Space is deemed to have been made unquestionably and irrevocably by the Member [citation:2][citation:4][citation:7].
3. Product Quotation
The Company displays the price of Products on its Site (the "Quotation"). The Quotation represents a valuation of Products when Members wish to sell all or part of their Products at a given time [citation:2][citation:4][citation:7].
The Quotation is set by taking into account the average of purchase and sale transactions carried out on the Site, weighted by the variation in the international price of Products [citation:2][citation:4][citation:7].
The Member is informed and expressly acknowledges that the Quotation may fluctuate upwards or downwards. The Quotation does not constitute a guarantee of a potential resale price of the Products [citation:4].
4. Purchasing Products
All Products on the Site are offered for sale by the Company. Some Products are immediately available, while others are made to order [citation:2][citation:7].
4.1. Immediate Purchase
The Member may purchase Products identified as in stock. The Member must select the desired Products so that they appear in their shopping cart. The cart is automatically updated in real-time to indicate the total purchase price [citation:2][citation:7].
If the shopping cart is not validated within 30 minutes of selecting the Products, it will be cancelled [citation:2][citation:7].
4.2. Pre-order
The Member may order Products identified as out of stock. The availability date of the Products is indicated on the Site at the time of selection [citation:2][citation:7].
4.3. Payment and Account Crediting
To make purchases, the Member must credit their "holding account." This can be done by bank transfer (2 to 5 days), by cheque (12 to 15 days), or by credit card. A first monthly transfer of at least €10 to the Member's bank account is offered once per month [citation:8].
5. Storage and Delivery
5.1. Secure Storage
The Member acknowledges that Products purchased on the Site are deposited under the direct responsibility of the Company in a highly secure storage system (the "Strongbox") [citation:12].
Products are stored mainly in Switzerland and, for some, in France. Products kept in Swiss storage are intended for storage only and, with the exception of certain conditions, cannot be withdrawn. Clients wishing to withdraw their products must opt for storage in France [citation:12].
The Company has taken out the required insurance in the context of its professional activity. In the event of a claim, the valuation of the Products will be based on their price according to the Quotation at the date and time of the claim [citation:12].
The Company reserves the right to change the storage location of products entrusted by its clients, after informing them [citation:12].
5.2. Home Delivery
The Member may request delivery of certain purchased Products. Delivery times are indicated on the Site for information purposes [citation:12].
By having Products delivered, the Member acknowledges that they may be subject to the payment of legally applicable taxes on the acquisition of the Products. Delivered Products can no longer be sold on the Site unless they are returned for verification of authenticity [citation:12].
6. Selling Products
The Member may at any time put Products up for sale at the price they wish, or accept the price offered by the Site to facilitate a quick sale [citation:5][citation:6].
The Member can define the sale price themselves by modifying the recommended price. The sale price, reduced by the applicable fees, is paid into the holding account within 72 hours following the resale of all Products mentioned in the Sale Order [citation:5][citation:6].
The Member may, at any time, instruct the Company to transfer all or part of the sums in their holding account by bank transfer to the bank details provided during registration [citation:5].
7. Fees and Taxation
The purchase fees are 0.5% of the transaction amount, and the sale fees are 3%. Storage fees are €5/month per weight bracket stored in the strongboxes [citation:10].
For information purposes, the main tax provisions applicable to purchase, sale, and gift transactions are available on the Site. This information may not reflect the latest legislative or regulatory developments and should not be interpreted as legal or tax advice [citation:1].
It is the Member's responsibility to inquire about and comply with the legal and tax obligations attached to the transactions they carry out on the Site [citation:1].
8. Risks and Liability
Purchases of precious metals are characterized by price fluctuations. The Member acknowledges and accepts that this random fluctuation prevents any guarantee on prices or on the valuation of the acquired precious metals [citation:1][citation:3].
Any decision to purchase or sell Products is made under the Member's sole and exclusive responsibility. The Member guarantees the Company against all complaints, claims, actions, and/or demands resulting from a breach of their obligations [citation:1][citation:3].
The Company declines all responsibility in the event of possible loss of information accessible in the Member's Personal Space [citation:3].
9. Anti-Money Laundering and Counter-Terrorism Financing
In accordance with international legislation on the fight against money laundering and the financing of terrorism, the Company is required to [citation:1]:
- • Declare sums and transactions that may come from drug trafficking, fraud, corruption, organized criminal activities, or may contribute to the financing of terrorism;
- • Make inquiries with the Member for transactions that appear unusual due to their terms, their unit or cumulative amount, or their exceptional nature.
10. Breaches and Sanctions. Account Closure
In the event of a breach of any of the provisions of these terms and conditions, the Company reserves the right to take any appropriate measures, including: suspending access to the Services, deleting any content published on the Site, and initiating any legal action [citation:3].
The Company reserves the right to terminate a client's access to all or part of the Services with immediate effect in the event of a breach of an obligation arising from these terms and conditions [citation:3].
The Company also reserves the right to refuse the subscription of a new Client or to suspend the commercial relationship when it finds that the Client's profile or usage is not adapted to the products and services offered [citation:3].
11. Modifications and Effective Date
We reserve the right to modify these terms and conditions at any time. Modifications will take effect upon publication. The use of the Site following the entry into force of these modifications will constitute acceptance of the new terms [citation:3].
